2010: The year to fix your immigration woes

A chunk of the population of developing countries still wants to reach the land of opportunities either legally or illegally and the craze has certainly increased and not decreased with each passing year.

Every year men and women with starry dreams enter USA illegally to build a life for themselves but during the process they still live with the fear of being caught by the law, after all they are not the legal residents of the country.

Illegal immigrants face several problems including overstaying in the country after expiration of visa, lying to obtain immigration benefits, death of their US citizen spouse who filed petition for them before getting the green card and several other problems, besides the desire to become US citizen starts to die a natural death as they feel that they might get convicted for all their wrong doings. Many illegal immigrants even die with the dream of getting the coveted 'green card' in their eyes.

The immigrant desperately wants to do something for it but is unsure as to how to deal with it and some even feel that nothing can be done about it. They feel that the situation might get worsened if they try to sort it out.

Certainly the concerns stated above are valid and an experienced immigration lawyer should be consulted in this regard as he or she would the best person to guide them as to what kind of help is available to them. Believe me now a lot of immigration problems can be sorted out, all thanks to the changes and proposed changes in US immigration law in recent times.

Some of the changes witnessed in the recent past in the US immigration laws are as follows:

October 2009 witnessed a landmark bill being passed which ended the automatic revocation of a visa petition in case the petitioner dies.

December 2009 saw Congressman Gutierrez of Illinois introducing the Comprehensive Immigration Reform for America's Security and Prosperity Act of 2009. The bill intends to amend certain enforcement measures while establishing a long term path to citizenship for illegal immigrants.

In 2010 members of the senate intend to introduce Comprehensive Immigration Reform bill which could offer long awaited relief to illegal immigrants.

Even now certain kind of relief is available to immigrants. Have a look:

Immigrants entering US with false names on their passports are eligible for waiver of representation in situations where his or her parents or US resident spouse are bound to suffer hardships in case the non citizen is deported back to his country.

In case of fraudulent marriages or false marriage status being reported for getting a green card, an immigrant may still be eligible for waiver of misrepresentation if his parent, spouse or children who are US citizens can prove that they have more favorable aspects to the case.

Even non citizens convicted of criminal offenses are still eligible for green card.

The year 2009 has been good for non citizens in US and 2010 is expected to be better. If you are a non citizen, just don't lose heart as you don't need to wait for the law to change as the existing laws can still offer you the well needed relief. Just have faith!!
